Hannah Dobbz Nine-tenths of the Law

With the growing concern around the foreclosure crisis and the emergence of the Take Back the Land movement and the Occupy Our Homes initiative, public discourse around the right to land in the United States has been considerably amplified in the past two years.Nine-tenths of the Law aims to chronicle the recent history of squatting and land reclamation in the United States, with an eye toward illuminating the murky legal framework that surrounds a citizen's right to shelter.Dobbz's book is not a guide to squatting, but neither is it an indictment of those who do. Rather, squatting emerges as one tactic in a larger toolbox for defending and reclaiming the right to shelter.Though this is Dobbz's first book, she has already toured the country extensively to promote her documentary Shelter (2008), which chronicled the squatting movement in the California East Bay, and provided the early impetus for the development of this book.Nine-tenths of the Law also examines contemporary squats across the country, particularly ones seeking to gain legal title by way of often archaic laws left over from the 19th century. Dobbz gives give historical context to the laws in which today's squatting practices are rooted.

Mark Goodale Anthropology and Law

An introduction to the anthropology of law that explores the connections between law, politics, and technology From legal responsibility for genocide to rectifying past injuries to indigenous people, the anthropology of law addresses some of the crucial ethical issues of our day. Over the past twenty-five years, anthropologists have studied how new forms of law have reshaped important questions of citizenship, biotechnology, and rights movements, among many others. Meanwhile, the rise of international law and transitional justice has posed new ethical and intellectual challenges to anthropologists. Anthropology and Law provides a comprehensive overview of the anthropology of law in the post-Cold War era. Mark Goodale introduces the central problems of the field and builds on the legacy of its intellectual history, while a foreword by Sally Engle Merry highlights the challenges of using the law to seek justice on an international scale. The book’s chapters cover a range of intersecting areas including language and law, history, regulation, indigenous rights, and gender. For a complete understanding of the consequential ways in which anthropologists have studied, interacted with, and critiqued, the ways and means of law, Anthropology and Law is required reading.

James E. Fleming Getting to the Rule of Law

The rule of law has been celebrated as “an unqualified human good," yet there is considerable disagreement about what the ideal of the rule of law requires. When people clamor for the preservation or extension of the rule of law, are they advocating a substantive conception of the rule of law respecting private property and promoting liberty, a formal conception emphasizing an “inner morality of law,” or a procedural conception stressing the right to be heard by an impartial tribunal and to make arguments about what the law is? When are exertions of executive power “outside the law” justified on the ground that they may be necessary to maintain or restore the conditions for the rule of law in emergency circumstances, such as defending against terrorist attacks? In Getting to the Rule of Law a group of contributors from a variety of disciplines address many of the theoretical legal, political, and moral issues raised by such questions and examine practical applications “on the ground” in the United States and around the world. This timely, interdisciplinary volume examines the ideal of the rule of law, questions when, if ever, executive power “outside the law” is justified to maintain or restore the rule of law, and explores the prospects for and perils of building the rule of law after military interventions.

T. Hoogsteen The Tradition of the Elders

The Tradition of the Elders, based on Matt 15:1-20 and Mark 7:1-23, explores how the oral law upheld and promoted the anti-Christian forces of Pharisaism and Sadduceism. As such, they appear repeatedly in the New Testament documents, often as «the law» and «the works of the law.» For example, consider: – "When Gentiles who have not the law do by nature what the law requires, they are a law to themselves, even though they do not have the law" (Rom 2:14). – "We ourselves, who are Jews by birth and not Gentile sinners, yet who know that a man is not justified by works of the law but through faith in Christ Jesus, even we have believed in Christ Jesus, in order to be justified by faith in Christ, and not by works of the law, because by works of the law shall no one be justified" (Gal 2:15-16). – "Tell me, you who desire to be under law, do you not hear the law?" (Gal 4:21). But which law do these legal references concern–the Torah, the oral law, or the Decalogue? This important distinction between the oral law and the Ten Commandments is what The Tradition of the Elders sets out to make clear. All New Testament exegetes, including teachers and students, can benefit from an increased understanding of the enmity of the oral law against the Gospel.

R. J. Snell The Perspective of Love

While many of the Reformers considered natural law unproblematic, many Protestants consider natural law a «Catholic thing,» and not persuasive. Natural law, it is thought, competes with the Gospel, overlooks the centrality of Christ, posits a domain of pure nature, and overlooks the noetic effects of sin. This «Protestant Prejudice,» however strong, overlooks developments in contemporary natural law quite capable and willing to incorporate the usual objections into natural law. While the natural law itself is universal and invariant, theories about the natural law vary widely. The Protestant Prejudice may respond to natural law understood from within the modes of common sense and classical metaphysics, but largely overlooks contemporary natural law beginning from the first-person account of subjectivity and practical reason. Consequently, the sophisticated thought of John Paul II, Martin Rhonheimer, Germain Grisez, and John Finnis is overlooked. Further, the work of Bernard Lonergan allows for a natural law admitting of noetic sin, eagerly incorporating grace, community, the limits of history, a real but limited autonomy, and the centrality of Christ in a natural law that is both graced and natural.

Matthew E. Ferris If One Uses It Lawfully

Are the Ten Commandments the standard for Christian living? There are many viewpoints on the place of the Mosaic Law today. Some affirm that while we are not saved through keeping the law, it remains our standard for living, a pattern to be followed. Others say we are free from the law. This brief examination of the law affirms all of God's revelation as Christian Scripture, but acknowledges covenantal differences in God's dealings with believers. The progress of salvation history, and our identification with Christ, has altered our relationship to the Mosaic Law. Using the Law «lawfully» requires us to recognize the way in which the New Testament, and chiefly the Apostle Paul, treats the law. Paul presents the believer as having died to the law, and serving now in the new way of the Spirit, a way that does not depend on the Mosaic law. The pattern for the New Testament believer remains Jesus himself. While keeping all of God's law, he went beyond its requirement to demonstrate a love for sinners that the law did not know.
